New York Children Attorneys

In custody disputes the courts today will appoint an attorney to represent the child or children. These attorneys are legally obligated to make a presentation of what the child wants. As incredible as it may seem a 4 year old can make a recommendation to his or her attorney indicating which parent he or she seeks to live with. This is the unfortunate state of the law as it exists today.

The attorney’s appointed to represent children in custody disputes were formerly called law guardians. For more than 30 years we have been involved with litigation where children had independent counsel.

Unwritten Preferences

Although the law is gender neutral concerning custody disputes. In the large majority of cases there seems to be a preference, if all things are about equal that the mother retain custody. This is especially true for young children. There are alternate solutions to custody disputes involving joint custody. However joint custody is generally only a solution if the parties reach an amicable settlement of the case. In situations where the case goes to trial the court will generally give custody to one parent and visitation to the non custodial parent.
