The father child relationship is recognized under New York State Law to be equal to the mother child relationship. The Law in New York is gender neutral. However, representing a father in a child custody matter in either the Supreme Court or the Family Court in New York State is a task that involves determination and experience. Although the law is gender neutral, most do not fight for custody of their children.

Child Custody generally refers to the rights and obligations that parents have related to where their children will reside during and after a divorce or separation. The courts either designate one parent as the primary residential custodial parent or joint custody is awarded to both parents but one is named as a residential custodial parent. Courts decisions as to who will be the residential custodial parent are often based on issues relating to what each parent's role has been in nurturing the child or children.
