The current state of the law in New York State is that there is no automatic presumption that the mother should get custody of the children. Instead, the court is expected to make a custody determination based on the best interests of the children without regard to the parents' respective genders. The law is not practiced so fairly however, and the courts usually presume that the mother should get custody, if she petitions for it, unless the father can prove otherwise.
