New York Parenting Agreements

In the event of a divorce, issues involving your children will be extremely important to you. If you and your spouse are in a reasonable talking basis, it is strongly suggested that you enter into an agreement regarding custody and visitation. Both of you should put your children’s interests as your primary responsibility and do everything you can to amicably resolve issues regarding your children. This is generally a superior way of dealing with these matters then having a judge who doesn’t know your family make the decision.

Parenting agreements or as they are sometimes referred to as a parenting plan can be helpful in dealing with issues your children will face in the future. During the process of developing the parenting agreement you must think about all of the issues involving your children’s lives. A written parenting agreement sets forth the responsibilities of each of the parents with regard to each other and the children.

The following is a listof important issues that should be considered when writing a parenting agreement:

  • Who gets custody?
  • What are the living arrangements?
  • When will the co-parent obtain parenting time (visitation arrangements)?
  • How will the children be supported?
  • Who will pay for the children’s college education, private or parochial school education, if appropriate?
  • Who will be responsible for medical care, dental care, medical insurance and/or dental insurance for the children?
  • What religion will the children have and who will be responsible for religious training?
  • Who will the children spend their Christmas, Easter, Thanksgiving and other school holidays with?

After you have considered all of the aforementioned issues, you should discuss these issues with a qualified attorney experienced in matrimonial and family law matters. They will provide you with guidance as to developing an appropriate family parenting plan or agreement.
