Do I Need a Prenuptial Agreement?

Prenuptial agreements are not for everyone. Prenuptial agreements deal with individuals who have property, assets, children from prior marriages, own businesses or seek to have a specific estate plan leaving assets to persons other than their spouse.

Before you or your fiancé get involved in the preparation of a prenuptial agreement, you should ask yourself some questions:

1. Do I own real estate?
2. Who do I want to inherit or receive this real estate if I should die or get divorced?
3. Do I have significant assets?
4. Who do I want to receive those assets?
5. Do I own part of a business or do I have a professional license, such as to a doctor, lawyer, dentist or architect? The business and the professional licenses can have a lot of value that you may not wish to share.
6. Do I currently earn a lot of money? If you are a high wage earner and your fiancé is financially challenged, you may not want to support him or her in the event of a dissolution of the marriage.
7. Do I have significant retirement assets? Retirement assets can be equitably distributed under certain circumstances in a divorce. If you want to keep them for yourself, you will need a prenuptial agreement.
8. Do I have an advanced degree? Advanced degrees or licenses are subject to equitable distribution, in a divorce.
9. Do I want my estate to go to your children from a former marriage or to your second spouse in the event of your death.

If any of the aforementioned issues are important to you, you need a prenuptial agreement! If you are already married, you need a post-nuptial agreement!
