An Annulment is a proceeding to invalidate the existence of the marriage from the date of its inception. When a marriage is annulled, it is as if the parties were never legally married. Grounds for Annulment in New York

The following is a list of the grounds to have a marriage annulled in the State of New York:

1. If the consent of one of the parties to the marriage was obtained by fraud. The fraud must deal with a significant issue. An example of this type of fraud is the parties agreeing to have children and one of the parties insisting that a birth control device be used to prevent pregnancy. In this case where there was a representation that the parties would have children and one spouse refuses, the marriage can be annulled based on the ground of fraud.
2. If one of the parties has a sexual disease, ailment or infirmity that prevents them from having sexual relations.
3. In New York State, if one of the parties to the marriage is under the age of eighteen (18), they can have the marriage annulled.
4. If the consent to marriage was a result of force or duress, the marriage can be annulled.
5. If one of the parties has a mental infirmity that prevents him or her from understanding the nature and consequences of a marriage, the marriage can be annulled.

Which is better, a divorce or an annulment? Generally speaking, if the marriage is for a short duration and there are no children of the marriage, the parties are better off having the marriage annulled. When you read in the newspapers, magazines and the internet about celebrities who get married and then change their minds, the marriage is usually annulled. The benefit of an annulment is the elimination of the marriage from the date of its inception. This means the marriage never took place. This eliminates the possible negative connotation associated with an individual being divorced.
